The present General Terms of Business are made between, on the one hand “Magic Life GmbH & Co KG, 1030 Wien, Landstrasser Hauptstrasse 153-155” and registered in the Viennese trade register under FN 168123s (which shall be called „Magic Life“ in the following) and, on the other hand, persons who want to purchase from Magic Life's online shop (who shall be called “the User” in the following) at these website addresses: www.magiclife.at or www.magiclife.com.
The present General Terms of Business for ordering from the online shop are accepted each time a purchase is made.
The present regulations shall govern all details appurtenant to purchases the User makes from Magic Life, starting with the order, delivery to payment.
The User can only purchase via the Internet page provided that he owns and uses a valid credit card or EC card.
When ordering, the User is obliged to fill in the Internet Order Form completely and truthfully with all the data he is expected to provide.
Orders placed by the User represent an offer as defined by law by which the User is bound subject to the right to exchange and return goods. By accepting the General Terms of Business and finally sending the order, this offer becomes valid. The order confirmation that the User will receive does not represent his acceptance but rather confirms that his order has been received.
Magic Life is obligated to deliver the items ordered online only while stocks last. Magic Life commits itself to inform the User immediately if an item is no longer in stock.
A sales contract will become valid only when the goods have been dispatched.
Magic Life does not sell products to minors in its online shop.
Magic Life obliges itself to deliver the ordered items as soon as possible. Otherwise, Magic Life will immediately inform the User that the order cannot be complied with.
The User has the right to return to Magic Life any damaged items or items that fail to meet his expectations within a fortnight upon the receipt of goods (cf. §6 Returning of Goods Ordered).
The User must pay the items after having placed his order using a credit card or Maestro Secure card. Payment is made via Qenta paymentsolutions GmbH; the User will be guided to the homepage of Qenta paymentsolutions GmbH to settle the payment. For any contingent problems or damage incurred within the scope of settling payment, Magic Life will not be held liable.
Prices are listed in Euro (€) and include VAT valid at the time when the order was placed. Any change of the VAT rate may be added to the item prices for the items.
The prices listed on the webpage at the time of order will apply.
Prices do not include delivery costs. Delivery costs incurred will be listed separately when the order is placed.
The ordered items will be dispatched with the Austrian postal service. Delivery costs will be listed when the order is placed.
From the moment the ordered items have been dispatched, the contract of sales between Magic Life and the User will become legally binding.
All items can be returned within a fortnight. In the event that faulty items have been delivered, apart from the right to return the goods, the User can also make warranty claims.
In each case, the User must inform Magic Life in writing to express his desire to exchange the goods or if he has noticed any contingent faults. The goods must be returned to “Magic Life GmbH & Co KG, 1030 Wien, Landstrasser Hauptstrasse 153-155” in their original packing and must include a note stating the reason for their return.
As a rule, the User will have to pay for returning the goods.
In the event of a valid revocation, services [goods or money] received by both parties must be returned, thus annulling all services rendered and any contingent benefit derived thereof.
The obligation to pay damages for whatever legal reason is restricted to cases where Magic Life or a person for whom it takes responsibility, have caused the damage by acting either willfully or with gross negligence. This does not apply to personal injuries.
Magic Life is not liable for any (un)successful access to its webpage and orders resulting from this, but only obliges itself to assist in achieving the desired result.
Magic Life's liability does not extend to disadvantages or damage resulting from the use of the internet, the interruption of services, unauthorized external intrusion, virus attacks or an act of God.
Magic Life is not liable for handling payments that have been made via Qenta paymentsolutions GmbH.
Magic Life reserves the right to keep data relating to the User, and especially about the use of storing cookies.
Magic Life collects, processes and stores personal data of the User while observing the current data protection laws to comply with the contract of sales and to maintain the relationship between customer and Magic Life.
By placing an order, the User agrees to the use of his personal data (which may be revoked any time) for maintaining the customer relationship and for the purpose of marketing.
Magic Life expressly points out to the User that data protection and the safe usage of networks for the purpose of transmitting data via public networks such as the internet cannot always be guaranteed with the current state-of-the-art technology. The customer himself is responsible for any data he reveals in the internet.
In the event that one clause of the present contract becomes invalid, this will not render the clauses of the remaining contract ineffective or the obligation to comply with the present General Terms of Business.
The present regulations and the contract made between ourselves and the User are subject to Austrian legislation. The legal venue is Vienna.
